These Terms of Service ("Terms") govern your use of the Powerhouse Prep iOS app (the "App") and the website at https://www.powerhouseprep.com (the "Website"), both provided by Urban Algorithm LLC ("we", "us", or "our"). Urban Algorithm LLC is located at:

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your own personal, non-commercial exam preparation. You may not copy, modify, distribute, sell, rent, sub-license, reverse engineer, or create derivative works from the App or its content, except as permitted by applicable law.

The App is licensed, not sold, to you. In addition to these Terms, Apple's Licensed Application End User License Agreement (available at apple.com/legal/internet-services/itunes/dev/stdeula/) applies to your use of the App, except where these Terms provide additional or superseding terms. Apple is not a party to these Terms and is not responsible for the App or its content.
Powerhouse Prep is a test preparation tool. We are not a college or institution of higher education, and we do not confer degrees or grant college credit. We are not affiliated with, endorsed by, or sponsored by the College Board (which administers CLEP), DSST, Prometric, or any testing organization. "CLEP", "DSST", and related names and marks are the property of their respective owners and are used here only to describe the exams the App helps you prepare for. We do not guarantee that you will pass any exam or receive any credit; each testing organization and college makes its own determinations, for which we are not responsible.
The question bank and study content in the App are licensed from Flying Prep. All content in the App and on the Website is protected by intellectual property rights owned by us or our licensors. You may use the content only for your own personal, non-commercial exam preparation. You may not republish, redistribute, sell, rent, sub-license, reproduce, or copy the content except as expressly permitted.
You agree not to: use the App or Website for any unlawful purpose; attempt to gain unauthorized access to our systems; interfere with or disrupt the App, Website, or servers; scrape, harvest, or bulk-extract content; or use the content to build or train a competing product. There are no user accounts and no user-generated content features in the App.
The App, the Website, and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Urban Algorithm LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App or Website will be uninterrupted, error-free, or that the content is accurate, complete, or current, or that using the App will produce any particular result.
To the maximum extent permitted by applicable law, Urban Algorithm LLC and its officers, members, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the App or Website. To the extent liability cannot be excluded, our total liability for any claim relating to the App or Website is limited to the amount you paid us (through Apple) for the App in the 12 months before the claim arose.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute relating to these Terms, the App, or the Website will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, except where prohibited by applicable law.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App or Website after a change takes effect constitutes acceptance of the updated Terms.
